Proper division of property begins with an analysis of the the character of the property – is it community or separate. All property in a divorce case is presumed to be community property until the owner can establish the property is separate.
The State of Texas recognizes informal marriages and, of course, formal marriages. Informal marriages occur when the parties agree to be husband and wife, live together as husband and wife, and hold themselves out to others as husband and wife.
